Abstract: An examination of American public education clearly evinces the authority of the states in the management and operation of their public schools. It is apparent that the state courts — specifically, the highest state courts as evidenced by the decisions of the Supreme Court of North Carolina — have played a significant role in defining the state's role in public education. This study provides insight in the areas of (1) governance, (2) employees, (3) pupils, (4) torts, (5) finance, and (6) property as they have been adjudged by the Supreme Court of North Carolina. The following questions were proposed for this study: (1) What are the landmark decisions of the Supreme Court of North Carolina affecting the public schools? (2) What legal principles affecting the public schools have been established by the decisions of the Supreme Court of North Carolina? (3) How do the decisions of the Supreme Court of North Carolina parallel or give direction to the development of the public schools of the state? (4) What are the trends or emerging issues evident in the decisions of the Supreme Court of North Carolina affecting the public schools?
